The LGPD, Brazilian Portuguese acronym for General Data Protection Regulation, is the Brazilian law that regulates the processing of personal data, that is, it was created to establish rules that offer more clarity on how we collect, store and share personal data, such as name, email address, etc.

Therefore, when we ask you to consent to the new Privacy Notice, please understand that it is precisely so that Atvos is complying with the LGPD and the information you share is safe.

We want to help you clarify your doubts about the General Data Protection Regulation.

Who does the General Data Protection Regulation apply to?

The LGPD must be complied with by all individuals and legal entities that process personal data, regardless of whether in physical or digital media, as long as they have a commercial/financial interest in the processing of the data.

Does the LGPD apply only to personal data collected on the internet?

No! The General Data Protection Regulation applies to any personal data processing, provided that the data has been collected within Brazil and has the objective of offering goods and services to people in the national territory, whether carried out through the internet or not. This way, your data can be collected through some paper form and still be subject to the LGPD regulation.

What is personal data?

Personal data is any information that can lead to the identification of an individual, already identified or identifiable. Examples of personal data are: name, address, e-mail, RG (ID), CPF (Individual Taxpayer Registration), location data, IP (internet protocol) address, profession, telephone number, personal characteristics, customs, habits, among others.

Who are the holders of personal data?

Holders are the individuals to whom the personal data subject to processing refer. Every individual is a holder of personal data.

What is personal data processing?

Personal data processing is any operation performed with personal data, such as collection, production, classification, use, access, sharing, storage and disposal.

What is sensitive personal data?

Personal data that can cause discrimination and place holders in vulnerable situations. That data is described in the General Data Protection Regulation in an exhaustive manner. They are: racial or ethnic origin, religious belief, political opinion, union membership or organization of a religious, philosophical or political nature, data related to health or sexual life, genetic or biometric data, when these are linked to an individual.

Who Supervises the personal data processing?

The Supervisor is the person responsible for ensuring that the rights are met and that the data is processed in an appropriate manner by the companies. What are my rights regarding personal data protection?

As the holder of personal data, you have the right to

Confirm the Existence of your personal data processing: we guarantee to you, upon request, confirmation of the existence or lack thereof of your personal data processing.

Access your personal data: we guarantee that you can be made aware of what personal data is processed by us and for what purposes.

Anonymizing, blocking or eliminating unnecessary, excessive or processed data that does not comply with the legislation: if you find that we are processing your data in non-compliance with the LGPD, you can ask us to anonymize, block or delete this data from our databases.

Data portability to another service or product provider: we guarantee that you can request your personal data in a structured and readable format, so that it can be shared with other similar companies.

Correction of incomplete, inaccurate or outdated data: if it turns out that we are processing any of your personal data in a manner that is wrong, incomplete, inaccurate or out of date, you can request the correction of this data at any time.

Information from public and private entities with which the controller has performed shared data use: you will be able to request information about which entities we share your personal data with.

Information about the possibility of not providing consent and the consequences of denial: whenever we need your consent in order to be able to process your personal data, you will have the option of not granting it. In this case, we will inform you of the consequences of denial.

Revoking of consent: it is your right to revoke the consent granted at any time, upon express request.

Elimination of Personal Data processed on the basis of consent: in the event that the processing of your personal data is carried out on the basis of your consent, you may, at any time, request the elimination of this data from our databases. Automated decision review: whenever we make decisions based on algorithms, you can question them. To that end, we will inform you of such decisions.

What are cookies?

Cookies are small files created by websites visited and added to your computer, through the browser. These files are commonly used to identify the visitor, to personalize the page according to the profile or to facilitate data transport between the pages of the same website.

There are several types of cookies, such as:

Tracking cookies: cookies that allow your data to be shared collectively between unrelated websites and with the intention of tracking and sharing an internet user's browsing habits.

Some of the most common features that use tracking cookies include social media ads (Like and Share buttons, comment sections, etc.). In some cases, you don't even have to click on an ad or social media sharing button in order for information from a tracking cookie about you to be transmitted back to a server owned by the person or company that created it. As soon as you load the page, the cookie is sent to the server from which it originated.
